Supreme Court Intervention: A vacation bench led by Chief Justice Surya Kant stayed the Delhi High Court’s December 23 order. The Court issued a notice to Sengar and posted the matter for further hearing in four weeks.
Public Servant Debate: The stay follows a controversial ruling by the Delhi High Court which suggested that an MLA might not be considered a "public servant" under the POCSO Act. The Supreme Court questioned this reasoning, noting it would be inconsistent if a constable or patwari were public servants while a member of the legislature was not.
Continued Incarceration: Regardless of the bail status in the rape case, Sengar remains in jail as he is serving a separate 10-year sentence for the culpable homicide of the survivor's father in judicial custody.
Case History and Convictions
Primary Offense: The case originated in June 2017 when a 17-year-old girl from Unnao, Uttar Pradesh, accused Sengar of kidnapping and raping her.
December 2019 Conviction: Sengar was convicted under the Indian Penal Code and the POCSO Act for raping a minor. He was sentenced to life imprisonment (for the remainder of his life) and fined ₹25 lakh.
Expulsion: Following nationwide outrage, Sengar was expelled from the Bharatiya Janata Party (BJP) in August 2019.
Additional Charges: In March 2020, Sengar and his brother were sentenced to 10 years in prison for the death of the survivor's father, who died in custody after being framed in an Arms Act case.
Survivor's Current Position
The survivor and her family have strongly opposed Sengar's potential release, citing fears for their safety. She welcomed the Supreme Court's stay order, stating her faith in the apex court to deliver justice.
